This year’s Expos, are scheduled for September in Bay of Plenty and October in Auckland.

WHAT IS AN EPP?

"Employee Protection Provision”, a requirement introduced in the Employment Relations Employment Amendment Act 2004 that aims to provide employment protection for employees in restructuring situations. “Restructuring” in relation to most employees is where their employer sells or transfers the business to another person.

 

Consequences for not having an EPP could be that your plans to restructure (sell) your business could be put on hold until you comply. In a recent case the Employment Relations Authority found that the parties had to comply with the law and agree on an EPP before the restructuring could take place.

 

If you are considering selling your business, be wary. If you fail to have a properly drafted EPP, it could mean that the Authority may direct you to negotiate one before you are able to sell.
